4. STUDY SESSION

4.1 MID-YEAR FINANCIAL UPDATE

The purpose of the study session is to update the Council on the status of General Fund finances midway through the 2009/10 fiscal year.  The Mid-Year Financial Update will be given, which compiles six months of actual FY 2009/10 data, along with a projection for the remainder of the year.  An economic outlook will be presented that discusses current and projected trends that will affect this fiscal year and beyond.  An update of the General Fund Five-Year Forecast will be provided.  New revenue, expenditure and reserve projections for fiscal years 2009/10 through 2013/14 will be discussed.

PUBLIC COMMENTS ON AGENDA ITEMS:  Except for public hearing items, comments from the public will be allowed on all agenda items at the time each item is called. Comments on public hearing items may be made when the hearing is opened.

PUBLIC COMMENTS ON NON-AGENDA ITEMS:  Comments from the public on non-agenda items will be heard under Agenda Item 13.

This time is reserved for City staff to brief the Council on departmental issues of interest.  No action will be taken on these matters except to possibly place a particular item on a future agenda for Council consideration.

11. CONSENT ITEMS

11.1 RESOLUTION -- ASSESSMENT LIEN AGAINST THE REAL PROPERTY LOCATED AT 300 CARRILLO STREET

This resolution, recommended by the Department of Community Development, confirms the special assessment lien in the amount of $6,536.90 against the real property located at 300 Carrillo Street for violations of the City Code that remain uncorrected by the responsible parties, Michael F. and Carol A. Dispensa, Anthony and Alicia Quattrochi, and Ronald J. and Sharie Barbieri and authorizes recording of a lien and placing the assessment on the property tax roll for collection.

11.2 RESOLUTION -- ASSESSMENT LIEN AGAINST THE REAL PROPERTY LOCATED AT 244 CARRINGTON STREET

This resolution, recommended by the Department of Community Development, confirms the special assessment lien in the amount of $20,554.74 against the property located at 244 Carrington Street for violations of the City Code that remain uncorrected by the responsible party, Bank of America Home Loans and authorizes recording of a lien and placing the assessment on the property tax roll for collection.

11.3 RESOLUTION -- DECLARING WEEDS AND RUBBISH IN THE CITY OF SANTA ROSA A PUBLIC NUISANCE

This resolution, recommended by the Fire Department, declares, pursuant to Chapter 9-08 of the Santa Rosa City Code, weeds and rubbish a public nuisance and authorizes the Fire Department to give notice thereof to affected property owners.

11.4 RESOLUTION -- FIRST AMENDMENT TO REIMBURSEMENT AGREEMENT FOR VARIABLE RATE DEMAND WASTEWATER REVENUE REFUNDING BONDS, SERIES 2004A
This resolution, recommended by the Finance Department, approves the form of and authorizes the execution and delivery of a first amendment to the reimbursement agreement relating to the Variable Rate Demand Wastewater Revenue Refunding Bonds, Series 2004A, and authorizes certain other actions in connection therewith.

11.5 RESOLUTION -- AMENDMENT TO THE CITY CLASSIFICATION AND SALARY PLAN TO CORRECT AND ADJUST THE DEPARTMENTAL APPLICATION SPECIALIST SALARY RANGE ON COUNCIL RESOLUTION 27554 FROM $4,490 - $4,713 - $4,948 - $5,196 - $6,252 PER MONTH TO $5,145 – $5,401 – $5,674 – $5,953 – $6,252 PER MONTH

This resolution, recommended by the Human Resources Department, amends the City Classification and Salary Plan to correct and adjust the Departmental Application Specialist salary range on Council resolution #27554 from $4,490 - $4,713 - $4,948 - $5,196 - $6,252 per month to $5,145 - $5,401 - $5,674 - $5,953 - $6,252 per month effective January 10, 2010.

11.6 RESOLUTIONS -- TRANSPORTATION FUND FOR CLEAN AIR / CALIFORNIA ENERGY COMMISSION AB 118 PROJECT PROPOSAL

These two resolutions, recommended by the Public Works Department, authorize that applications be submitted to the Bay Area Air Quality Management District (BAAQMD) requesting funds from the Transportation Fund for Clean Air (TFCA) Regional Fund, and to the California Energy Commission (CEC) requesting funds from the AB 118 - Alternative and Renewable Fuel and Vehicle Program, to upgrade City-fleet Toyota Prius Hybrid vehicles to “plug-in” hybrid, and fund electric vehicle charging stations.  It is further recommended that the Council authorize the Director of Public Works to execute the agreements with the BAAQMD and CEC to complete the project if successful in obtaining grant funds, and authorize the Chief Financial Officer to establish a project entitled “Electric Vehicle Conversion and Infrastructure” with appropriations in the amount of the grant, source of funds being the grant.

11.7 ORDINANCE ADOPTION -- COMMERCIAL VEHICLE PROHIBITIONS

This ordinance, introduced at the February 2, 2010 Regular Meeting, prohibits commercial vehicles from using: Burt Street from Santa Rosa Avenue to Madrus Rose Street; Winterhaven Avenue from Parkcreek Drive to Old Petaluma Hill Road;  Ripley Street throughout its entire length within the city; and Talbot Avenue from Montgomery Drive to Sonoma Avenue.

12. REPORT ITEMS

**12.1 REPORT -- 1111 PETALUMA HILL ROAD - SANTA ROSA PATIENT GROUP MEDICAL CANNABIS DISPENSARY PERMIT DENIAL APPEAL

BACKGROUND:  On August 17, 2009, the applicant, Mina Sohaei filed a Medical Cannabis Dispensary Permit application to operate a Medical Cannabis Dispensary at 1111 Petaluma Hill Road.  This application was denied by the City Manager on November 12, 2009 based on the existing crime levels and specific types of crime in the surrounding neighborhood (South Park) as identified by the City of Santa Rosa Police Department.  An appeal of this decision was filed by the applicant’s attorney with supporting documentation identifying the grounds of the appeal being provided in a letter dated December 21, 2009.

RECOMMENDATION:  It is recommended by the Community Development Department that the Council, by resolution, deny the appeal and uphold the original determination denying the Medical Cannabis Dispensary Permit to operate a Medical Cannabis Dispensary at 1111 Petaluma Hill Road.

12.2 REPORT – APPROVAL OF PROFESSIONAL SERVICES AGREEMENT FOR EXECUTIVE RECRUITMENT SERVICES

BACKGROUND:  At the January 12, 2010 meeting, Council appointed an ad hoc subcommittee for the purpose of interviewing executive recruitment firms specializing in public sector executive searches in California.  Interviews were conducted and at the January 26, 2010 meeting, Council accepted the subcommittee’s recommendation of Bob Murray & Associates as the firm to recruit for a new City Manager.  The Human Resources Department was directed to prepare a professional services agreement, which has been prepared and attached for Council approval.  Representatives from Bob Murray & Associates will be present and ready to begin discussions on the qualifications for the new City Manager.

RECOMMENDATION:  It is recommended that the Council, by resolution, approve the agreement for professional services with Bob Murray & Associates in the amount of $16,500 plus expenses not to exceed $6,500 and authorize the Interim City Manager to sign and execute the contract.  It is further recommended that Council begin the discussion on the qualifications of the new City Manager.

12.3 REPORT – AGREEMENT CONVEYING A CONSERVATION EASEMENT WITH THE SONOMA COUNTY AGRICULTURAL PRESERVATION AND OPEN SPACE DISTRICT FOR ROSELAND CREEK COMMUNITY PARK AND TRAIL – PHASE 1A

BACKGROUND:  This resolution would authorize the Mayor to execute an agreement conveying a conservation easement with the Sonoma County Agricultural Preservation and Open Space District over 1400 Burbank Avenue (Roseland Creek Community Park and Trail – Phase 1a)

RECOMMENDATION:  It is recommended by the Recreation, Parks & Community Services Department that the Council, by resolution, enter into an agreement conveying a conservation easement with the Sonoma County Agricultural Preservation and Open Space District for the property at 1400 Burbank Avenue, also known as Roseland Creek Community Park – Phase 1a.
